elpizzero is a technology platform that allows restaurants and hospitality establishments to manage their digital menu, receive online orders (collection at the premises or home delivery) and manage bookings. Each restaurant has its own public space (subpage of the type /r/<restaurante>/) where its end customers can place orders.

The holder acts as provider of the technology service. We are not a party to the commercial relationships between the restaurant and its end customers: the preparation of the order, its delivery, the prices, the quality of the product and after-sales service are the exclusive responsibility of the advertising restaurant.

3. Conditions of use

• Access to and consultation of the site is free of charge and does not require registration.
• Placing orders may require providing contact and delivery details; creating an account is optional.
• Registering a restaurant on the platform requires express acceptance of the Terms and Conditions of the service.
• The user undertakes to make lawful use of the site, not using it for activities contrary to the law, morality or good faith.
• Total or partial reproduction of the software, design and original content without the express authorisation of the holder is prohibited.

4. Intellectual and industrial property

The software, design, source code, logos, trademark, descriptive texts and original graphic elements of the portal are the property of Ángel Rives García or of their respective authors and are protected by intellectual and industrial property laws.

The name of the restaurant, its menu, product photographs, descriptions, prices and other content published on each restaurant page are the responsibility and property of the advertising establishment, which holds the rights necessary for their publication and expressly authorises their use by the platform.

5. Information on products and orders

• The information published about the products (prices, descriptions, ingredients, allergens, photographs) is provided and maintained directly by each restaurant.
• elpizzero does not guarantee the accuracy, completeness or continued currency of that information: typographical errors, changes to the menu or to prices that the restaurant has not reflected in time may occur.
• The prices shown include VAT unless otherwise indicated, and may include delivery charges added at checkout depending on the delivery zone.
• Preparation and delivery times are estimates by the restaurant and may vary depending on the volume of orders, traffic or other circumstances.
• The availability of products may change without prior notice if the restaurant runs out of stock or closes temporarily.

6. Food information and allergens

In accordance with Regulation (EU) 1169/2011 on the provision of food information to consumers, restaurants are responsible for correctly declaring the presence of allergens in each product. The platform provides the fields so that this information is made visible to the customer for each product. If you have any allergy or intolerance, we recommend confirming the information directly with the restaurant before placing your order.

7. Payments

• Orders are paid through the payment provider selected by each restaurant (cash on delivery or card payment via a secure external gateway).
• The platform does not store full credit card details: the financial information is handled entirely by the payment provider, certified under the PCI-DSS standard.
• Returns and refunds are the responsibility of the restaurant in whose name the order was charged.

8. Exclusion of liability

• The holder is not liable for damages or losses arising from the information published by the restaurants or from the quality, food safety or delivery of the products ordered.
• The holder does not guarantee continuous and uninterrupted availability of the service: interruptions may occur owing to maintenance, updates or external technical causes.
• Links to third-party websites are provided for information purposes; the holder is not responsible for their content.

9. Data protection

The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD). More information in our Privacy Policy and Cookie Policy.

10. Governing law and jurisdiction

These conditions are governed by Spanish law. For any dispute arising from access to or use of this website, the parties submit to the courts and tribunals of Alicante, unless consumer regulations or the applicable law establish another forum.
